2            Camps

2.1      General – Safety and Protection

The following issues are highlighted as critical,
·         Riots were reported in Idomeni. The living conditions and the unavailability of clear information are deemed to exacerbate the tension across the various ethnic groups at the camp.
·         Children live in an unsuitable and hazardous environment, exposed to diseases and infections as well as potential abuses.
·         Fires spread in more than one camp. Their nature was not always identified.
·         There are no interpreters and people often communicate with volunteers and the military through sign language. Furthermore, according to the UNHCR's Voulgaris, mismatched birth dates, along with variations in the spellings of Arabic names, have often caused delays and issues with official processes.
·         Doctors are insufficient and the risk of infections spreading is reported high in all the camps.
·         Babies are reported born without assistance. In Elliniko camp (Attika region) a baby died of birth complications because no assistance was provided despite several requests raised by volunteers to take the woman in labour to the hospital.
As a term of reference, it is deemed relevant to highlight that according to a report dated March 11, 2016 (including a letter by Vitsa Dimitrios, Deputy Minister of Defense, in response to a letter by Nicholas Kalantzi, Mayor of the Municipality of Ziros),
·         Camps are open and supervised accommodation structures. This means that the guests/’s families have been identified in the islands, recorded at entry and enter or leave the center based on the identification document and proof of registration. No other refugee or Greek enters the center without the proper license can be issued by the head of the center or the appropriate municipality.
·         Guests refugees staying in rooms (prefabricated buildings or tents) and food is
·         There is a permanent health unit of the Ministry of Health
·         There are interpreters from the Department of Migration Policy
·         There is refugees information service specialist clerk for children
Sanitization and cleaning of provided toilets is unclear. Agreements to be undertaken by the municipality in agreement with the manager of the center.

2.2      Additional Camps in Northern Greece *not* indicated in the Refugee Camps Map

The following additional camps located in Northern Greece are not listed in the following subsections,
·         Thessaloniki port: 325 people according to report dated March 18, 2016.
·         Eleftheroupoli (NW Kavala): 210 people according to report dated March 18, 2016.
·         Nea Karvali (located fast east of city of Kavala): 731 people according to report dated March 18, 2016.
·         Kozani (SW Thessaloniki): 400 people according to report dated March 18, 2016.
·         Konitsa: 162 people according to report dated March 18, 2016.
·         Pieria: 190 people according to report dated March 18, 2016.
Additional information regarding the above camps, including their management, is currently not available.

2.3      Cherso

2.3.1       General

According to two different reports, No NGO presence. Only private volunteers.
A team of about 50 volunteers are currently trying to establish an efficient and methodical goods distribution system to for clothes and toiletries. Packages per tent are being prepared based on actual needs to both provide humane support and reduce waste.
The UNHCR came a few days ago, walked around and left. The relocation registration promised in Idomeni by the UNHCR consists in one abandoned small white booth, forgotten in a desolate corner of the camp, next to the military quarters’ tent. The empty booth signals the wider fact that there is simply no one to talk to, to speak about your options as a refugee there. And it is yet another hint that the relocation program, however much it is spoken about, is nowhere to be found. Cherso camp is in the middle of nowhere, secluded from any form of support, whether humanitarian or legal.

People do not know how to cope with infections and infected hands resulting from contact with infected materials and unsanitary environment. The risk of transmission of infectious diseases is high.
Many people ill with cold and flu.
According to DPA, The German Red Cross, in cooperation with the Red Cross of Finland, is on the move to come down to Idomeni with two complete field hospital units. They will include an operating room for surgery, special facilities for giving birth, a laboratory and a freezer room. The German Red Cross says the units will arrive near Idomeni on March 20, 2016 (information available on March 18 – no updates available) and will be operational in Nea Kavala and Cherso on March 22, 2016.

2.7      Idomeni

2.7.1       General

The camp in Idomeni is located approximately 20km north of Nea Kavala. The state is absent from the camp, barring a few police officers surveying the final 100 metres leading to the «exit gate». Various incidents were reported and the safety of people is not guaranteed.
Police do not allow taxis to approach the camp, thereby putting more stress on the already exhausted people seeking the bare necessities outside of the camp.  Small fires for heating, burning wood, garbage, plastic.
UNHCR, doctors, those preparing food and more generally all those providing all kinds of aid, provide the only significant amount of aid (randomly distributed) to desperate, exhausted and ill people (many of whom are elderly and small children), living in adverse conditions.

Cases of Hepatitis A and of diarrhea were recently detected. Hepatitis A, diarrhea and the more serious dysentery may be caused by crowding, lack of sanitation and clean water. MSF and MDM have teams in the camp. On March 18, 2016, the German Red Cross society declared that a mobile health station will be sent onsite to for support. The station will be equipped to serve 10,000 people.
According to DPA, The German Red Cross, in cooperation with the Red Cross of Finland, is on the move to come down to Idomeni with two complete field hospital units. They will include an operating room for surgery, special facilities for giving birth, a laboratory and a freezer room. The German Red Cross says the units will arrive near Idomeni on March 20, 2016 (information available on March 18 – no updates available) and will be operational in Nea Kavala and Cherso on March 22, 2016.
According to a report dated March 7, 2016, in the Greek daily To Vima, the spokeswoman for the MSF refugee mission, Vika Markolefa, warns against the danger of epidemics, “We are very concerned about the health situation. Since there are not enough toilets and showers, many people are forced to go in the fields. When it rains, faeces spreads everywhere. This is particularly tragic for children, who are always playing on the ground. We fear the outbreak of an epidemic that could spread through the water.”
Babies were delivered at the camp. Pregnant women and people with heart condition present at the camp.

2.9      Nea Cavala/Nea Kavala

2.9.1       General

The refugee camp in Nea Kavala, accessible through the road bordering the village, and which is in close proximity to a supermarket, has been in operation since the end of February 2016. It is an open structure, without restrictions on exit. It is operated exclusively by the military, that is, there is no civilian staff from the Ministry of Interior/Migration, which creates an issue regarding whose jurisdiction the camp is under. The camp lies outside the Diavata- Idomeni axis (though very close to the latter), and very few organizations visit it, so that very few humanitarian aid materials are available. Aid not distributed following a system, as no civilian staff is available to carry out this work. Staff present (reported on March 5, 2016) consisted of 7 people in total, all military, and the lieutenant in charge of the camp (who performs his duties on a shift basis), and who appeared to be fully aware of his duties, responsibilities, as well as of objective restrictions, as there is no aid, infrastructure or sufficient staff available.

3            Additional Camps

3.1      Attica - Elliniko, Athens

3.1.1       General

Set up in mid-December 2015 by the Greek government in the area of the former airport in the Athens suburb of Elliniko. Since the airport was shut down in 2001, the site has mainly been used for sports events such as the 2004 Summer Olympics and includes a hockey stadium and a baseball stadium.

In a context of urgent evacuation of the Greek islands, leading to thousands of refugees being redirected to the mainland, as well as in a context of a 3 week ban on reporters and tv crews to enter hotspots, we present an initial attempt t document the living conditions in several camps that have been set up around Greece.

PLEIADES' PRESS RELEASE ON MILITARIZATION OF HUMANITARIAN RESPONSE TO REFUGEES

PRESS RELEASE The Hellenic Action for Human Rights – “Pleiades” alarms on the –literally- last minute addition to a Law voted by the Greek Parliament on Sunday 21-02-2016, titled “Measures on precipitating the Government’s work and other provisions” [Law 4368/16 (21 A'/21.02.2016)], by which the Greek Army took on “exclusively all that relates to the operation of Reception Centers and Hotspots, in regards to the transportation, accommodation, catering and health care for refugees and immigrants", "in declination of any other legal provision”. The Army will also be controlling and “coordinating” NGOs providing volunteer services to refugees. This Law was irrelevant to the rest of the context, was not pre-assessed by the Scientific Service of the Parliament (as opposed to the rest of the Law’s text which was, in accordance to the Rules of Procedure) and did not comply with the strict time-limit in which such additions and amendments are permitted by law. Nevertheless this amendment did become art.96 of the Law and its content is raising serious concerns. We strongly decry the militarization of the humanitarian response to incoming refugees and express our outmost concern on the detrimental semantics of democracy, of the threat that is implied by THE ARMY taking over on such a delicate humanitarian issue such as the reception of displaced populations fleeing war or internal conflict in the countries of origin, “exclusively managing”, from now on, according to the newly voted legislation, their housing, nutrition, transportation and medical support, as well as the activity of those volunteering in support of them. This is nothing less but an expression of a sentiment, that the refugee population is reviewed as an “invader” and “a threat to the national security and public order”. Issues under the control of the Minister of Defense have no transparency, for reasons of national security. The response and governmental bodies’ acts and omissions towards incoming refugees should be as transparent as possible, to ensure, among others, accountability. Moreover, NGOs, and especially those thousands of volunteers currently present in the island of Lesvos, who have already been alarmed by their unprecedented profiling and harassment projected in a relevant legislation voted by joint Ministerial Decision, dated 28-01-2016 currently in practice, cannot be deemed willing to be “directed and coordinated” by the Greek Army. That fact would drive them away, depriving Greece and Europe from one of its major strengths in setting first reception centers and response mechanisms for displaced persons. We can only assume that MPs voting in favor of such a legislation are ignorant of the serious implications it entails. Legalizing such a provision, without appropriate assessment, not only violates the Constitution but it can have severe consequences in oppressing the current status of automated responses. In light of the above, we urge the Greek Government - to urgently declare null art.96 of Law 4368/16 - to not deliver asylum seeking population to the “exclusive care” of the Greek Army, and not subject all relative authorities AND civil society to “army control and direction”. Such a stance would point to the regim’s de facto and de jure facismism. - to put an immediate end to the attempts to subject civil society to state control, management, evaluation by non-experts, “coordination and pre-approval of activities", rendering them governmental, instead of non-governmental, factors. The last minute amendment has as follows: “Article 96 Contribution of the Ministry of National Defense in managing the refugee crisis and setting up a coordinating body The Ministry of National Defense (YP.ETH.A.) notwithstanding any other provisions may: a. To take all necessary actions or enter into contracts with third parties for the execution of works, providing of services, supplying of goods or leases in reference to the establishment, construction and maintenance of First Reception Centres (KE.P.Y.), Welcoming Centres and Identification (K.Y.T.) and Open Temporary Reception and Welcoming Facilities for refugees and immigrants and the operation of these Facility Centres, solely in regards to the transportation, accommodation, catering and health care for refugees and immigrants. The contracting procedure of the preceding paragraph may, for reasons of urgency and unforeseen need, taken into account and for reasons of national safety or public order, which should be specifically justified, be conducted after negotiations without the publication of a contract announcement, notwithstanding of any other provisions of national law, be subjected to the application of European Union law on public procurements. b. To direct and coordinate, in cooperation with the Asylum Service and the First Reception Service, other public services and departments, as well as social institutions and non governmental organizations which assist in the functioning of the KE.P.Y/K.Y.T. and Open Reception Temporary Facilities and for Temporary Welcoming, exclusively in regards to the transportation, accommodation, catering and health care of refugees and immigrants, in accordance with everything provided in case a of this paragraph. The Headquarters of National Defense (G.E.ETH.A.) recommends a Central body for the Management and Coordination of the Refugee Crisis (KE.S.O.D.P.) to service the purposes of the preceding paragraph. A joint decision of the Ministers of the Interior and Administrative Reconstruction, National Defense and Marine and Island Policy, defines its responsibilities, its staffing and every other necessary detail. Local Coordinating Centres (TO.S.KE.D.P.) are recommended with similar decisions requiring and also determining their responsibilities, their staffing and every necessary detail. 2. Expenses for actions being undertaken in context with paragraph 1 will be covered by appropriations either through the regular Budget or the Public Investment Programme in excess of the allotted appropriations of the Ministry of National Defense. From the official Proceedings of OZ Meeting of the Hellenic Parliament dated February 20, 2016 which voted the following legislation: "Measures for the acceleration of the government work plan and other provisions".

ΑΝΑΚΟΙΝΩΣΗ
Η αναγνώριση του ρατσιστικού κινήτρου στην υπόθεση του Σαχζάτ Λουκμάν

Η απόφαση 398/2014 του Μεικτού Ορκωτού Δικαστηρίου Αθηνών στην υπόθεση ανθρωποκτονίας του Σαχζάτ Λουκμάν αποτελεί σταθμό για την αντιμετώπιση της ρατσιστικής βίας από την ελληνική δικαιοσύνη. Το Δικαστήριο επιβεβαίωσε την άποψη που είχε υποστηρίξει και το Δίκτυο Καταγραφής Περιστατικών Ρατσιστικής Βίας ότι το έγκλημα είχε ρατσιστικό κίνητρο, δηλαδή υπαγορεύθηκε «από αισθήματα ρατσιστικού μίσους».

Το Δικαστήριο αιτιολόγησε την απόφασή του αναφερόμενο στα ποιοτικά στοιχεία και τις ειδικές περιστάσεις διάπραξης του εγκλήματος που το οδήγησαν στο συμπέρασμα αυτό:

«[ε]πίθεση από υπέρτερους αριθμητικά δράστες – μεταμεσονύκτια ώρα – κατά αγνώστου ανθρώπου που στοχοποιήθηκε ως Πακιστανός μετανάστης, με τη χρήση μαχαιριών, σε περιοχή που συχνάζουν αλλοδαποί μετανάστες και είναι ευχερής ο εντοπισμός του θύματος, χωρίς προηγούμενη πρόκληση από αυτό, πλήξη με αλλεπάλληλες μαχαιριές, διαφυγή με λήψη των πειστηρίων και απόκρυψη των διακριτικών γνωρισμάτων του μεταφορικού μέσου, κίνηση χωρίς το φόβο του εντοπισμού και της σύλληψης (…)».

Όπως επανειλημμένα έχει επισημάνει το Δίκτυο, τα στοιχεία αυτά είναι ορισμένα από τα στοιχεία που διακρίνουν τα ρατσιστικά εγκλήματα στην πλέον κλασική τους μορφή. Μάλιστα, από τις πρώτες καταγραφές του Δικτύου προέκυψε και δόθηκε έμφαση στο συγκεκριμένο μοτίβο ρατσιστικού εγκλήματος. Σε κάθε περίπτωση, όμως, ο νομικός συλλογισμός που στοχεύει στην αξιολόγηση του κινήτρου ενός εγκλήματος προϋποθέτει την εξέταση των πραγματικών περιστατικών στο σύνολό τους και τη μεταξύ τους διασύνδεση. Επομένως, ενώ ορθώς το Δικαστήριο επισημαίνει ότι η εύρεση υλικού στην οικία ενός εκ των κατηγορουμένων και η ύπαρξη ακραίων πολιτικών πεποιθήσεων  δεν αρκεί από μόνη της για να προσδοθεί ρατσιστικός χαρακτήρας στην αξιόποινη συμπεριφορά αμφοτέρων των κατηγορουμένων, πρέπει να τονιστεί ότι οι ενδείξεις διασύνδεσης ενός υπόπτου/κατηγορουμένου με ρατσιστικές και νεοναζιστικές ομάδες οφείλουν πάντα να διερευνώνται από τις ανακριτικές και δικαστικές αρχές, ως πιθανά αποδεικτικά στοιχεία του ρατσιστικού κινήτρου.

Επιπλέον, η εξέταση του κινήτρου ενός εγκλήματος προκειμένου να αποσαφηνιστεί το ενδεχόμενο του ρατσιστικού απαιτεί σε ορισμένες περιπτώσεις την συνεκτίμηση στοιχείων προφανών και κάποιων λιγότερο φανερών. Δεν αποκλείεται στοιχεία προφανή, όπως λ.χ. η αλλοδαπότητα του θύματος, να μην αρκούν ώστε να καταλήξουμε σε ασφαλές συμπέρασμα. Με άλλα λόγια, υπάρχει περίπτωση ένα έγκλημα με θύμα άτομο άλλης εθνικής προέλευσης να μην αποτελεί ρατσιστικό έγκλημα, αλλά οι δικαστικές αρχές οφείλουν να το εξετάσουν και να απομακρύνουν τη διάσταση αυτή αιτιολογημένα.

Ωστόσο, υπάρχουν και εγκλήματα στα οποία τα κίνητρα είναι μεικτά και ο ρατσισμός ή η προκατάληψη είναι ένα από αυτά. Έτσι, λ.χ. δύναται το κίνητρο να είναι η αφαίρεση περιουσιακών στοιχείων (συνήθως χρήματα) από το αλλοδαπό θύμα, αλλά η αλλοδαπότητα/ευαλωτότητα του θύματος να αποτελεί το στοιχείο που επιτρέπει ή υποκινεί τους δράστες να διαπράξουν το έγκλημα και συχνά με τόσο βάναυσο τρόπο ώστε στην ουσία να υποδηλώνεται η απόλυτη απαξίωση της αξιοπρέπειας του θύματος λόγω της εθνικής του προέλευσης. Συνήθως, ειδικότερες περιστάσεις του τρόπου τέλεσης του εγκλήματος μαρτυρούν και συντείνουν στο συμπέρασμα ότι το ίδιο έγκλημα δεν θα είχε διαπραχθεί έναντι ατόμου που δεν φέρει τα ίδια χαρακτηριστικά (λ.χ. έναντι ατόμου που δεν είναι αλλοδαπός και χωρίς χαρτιά ή δεν είναι τρανς) ή κι αν ακόμα το ίδιο έγκλημα είχε διαπραχθεί, δεν θα ήταν εξίσου βίαιος ο τρόπος.

Η ρατσιστική βία, όπως και άλλες σοβαρές παραβιάσεις ανθρωπίνων δικαιωμάτων, είναι συνυφασμένη με έντονα αρνητικά συναισθήματα και μακροχρόνιες επιπτώσεις για το θύμα, όπως φόβο, θυμό, απογοήτευση και δυσκολία, αν όχι αδυναμία, αποκατάστασης της βλάβης που υφίσταται. Για το λόγο αυτό, στο πλαίσιο της πολυεπίπεδης στρατηγικής αντιμετώπισης που χρήζει η ρατσιστική βία  ως δομικό και συλλογικό πρόβλημα μιας κοινωνίας, δεν πρέπει να υποβαθμίζεται η ατομικότητα του θύματος και η προσπάθεια επανόρθωσης των συνεπειών του ρατσιστικού εγκλήματος σε αυτό. Ο αντίκτυπος ωστόσο της τιμωρίας των δραστών υπερβαίνει την ατομική περίπτωση και εκφράζει στην πράξη την προστασία κάθε ατόμου διαφορετικού και κάθε μέλους μιας κοινότητας που στοχοποιείται από άτομα και ομάδες εμφορούμενα από ρατσιστικό, ομοφοβικό ή τρανσφοβικό μίσος.

Γίνεται επομένως αντιληπτό ότι η αναγνώριση της επιβαρυντικής περίστασης και η συνακόλουθη αύξηση της ποινής εξυπηρετεί δύο σκοπούς: πρώτον, συμβολίζει την ειδική απαξία που μια δημοκρατική κοινωνία με σεβασμό στη διαφορετικότητα επιφυλάσσει στη ρατσιστική βία και δεύτερον, ανταποκρίνεται κατά τρόπο αναλογικότερο στη βαναυσότητα της πράξης έναντι του θύματος που συνήθως είναι πιο ευάλωτο και δεν έχει ουσιαστική πρόσβαση ή αντιμετωπίζει ουσιώδη εμπόδια στην πρόσβαση στη δικαιοσύνη.

Ο Σαχζάτ Λουκμάν δολοφονήθηκε γιατί στο πρόσωπό του στοχοποιήθηκε κάθε άτομο με τα δικά του χαρακτηριστικά. Η αναγνώριση του ρατσιστικού κινήτρου των καταδικασθέντων δεν αποτελεί μόνο νομική νίκη των φορέων που εργάζονται για την καταπολέμηση της ρατσιστικής βίας, αλλά εν τέλει, της ίδιας της Δικαιοσύνης που με την πλήρη αιτιολογία της απόφασής της δείχνει αντανακλαστικά αφύπνισης έναντι του ρατσιστικού εγκλήματος.

Το Δίκτυο Καταγραφής Περιστατικών Ρατσιστικής Βίας εκφράζει την ικανοποίησή του για την απόφαση αυτή, ιδίως δεδομένου του κλίματος ατιμωρησίας που καλλιεργήθηκε για μακρά περίοδο. Ας αποτελέσει η απόφαση αυτή ένα ακόμα έναυσμα ώστε κανένα έγκλημα υποκινούμενο αποκλειστικά ή σωρευτικά από μίσος ή προκατάληψη να μην υποτιμάται ως κοινό έγκλημα.
