Όταν οι «χωρίς τόπο» εν-τοπίζονται...

Η χορωδία της ουτοπίας

Όταν οι «χωρίς τόπο» εν-τοπίζονται...

«Θέλω να γίνω τραγουδιστής» μας είπε ο δεκάχρονος Φώτης από το Ζεφύρι. Και με το τραγούδι του ξεκίνησε η συνέντευξη τύπου για την προσπάθεια που καταβάλλεται πρώτη φορά στην Ελλάδα να δημιουργηθεί χορωδία (και αργότερα ορχήστρα) από παιδιά που δεν θα μπορούσαν ποτέ να έχουν την ευκαιρία να ασχοληθούν με τη μουσική.


Για να το θέσουμε καλύτερα: πρόκειται για μια χορωδία με παιδιά που δεν θα είχαν ποτέ την ευκαιρία να ασχοληθούν με οτιδήποτε άλλο εκτός από τον καθημερινό αγώνα για το βιοπορισμό των ίδιων και των οικογενειών τους, εκτός από τον καθημερινό μόχθο να παραμείνουν σε ένα χώρο και να μην εκτοπίζονται διαρκώς από την κάθε φορά πατρίδα τους, από το σχολείο, από τη γειτονιά.
Ο Αρμπέν από την Αλβανία, λίγο μεγαλύτερος από τον Φώτη, ήρθε από μικρός στην Ελλάδα. Την Ελλάδα νιώθει ως πατρίδα, αν και ξέρει ότι η καταγωγή του είναι από αλλού.


«Λίγο εδώ και λίγο εκεί».


«Αυτό το μπέρδεμα στις ταυτότητες είναι ένα βασικό κριτήριο εισδοχής στη χορωδία» μας είπε η Ηλέκτρα Κούτρα, υπεύθυνη της μη κυβερνητικής οργάνωσης Ελληνική Δράση για τα Ανθρώπινα Δικαιώματα, η οποία ανέλαβε την πρωτοβουλία για τη δημιουργία μιας τέτοιας προσπάθειας. «Εμπνευσμένοι από το Sistema της Βενεζουέλας [βλ. τεύχος 169] αποφασίσαμε να κάνουμε κάτι αντίστοιχο. Μια χορωδία για τα παιδιά που δεν θα μπορούσαν ποτέ να έρθουν σε επαφή με τη μουσική και την τέχνη και δεν θα ενθαρρύνονταν να εκφράσουν τις ανησυχίες και τις ελπίδες τους. Εδώ, όμως, προσπαθούμε να δώσουμε και μια άλλη διάσταση, πολύ σημαντική. Να γίνει μια χορωδία των παιδιών τού κόσμου. Μια χορωδία για παιδιά πολλών διαφορετικών εθνικοτήτων και πολιτισμών, που έχουν ταλαιπωρηθεί και τείνουν να παραιτηθούν από την ελπίδα, τα οποία ωστόσο αποτελούν το ολόγραμμα των κοινωνιών. Έτσι θα έπρεπε να βλέπουμε τις κοινωνίες μας. Ως έναν παγκόσμιο χώρο, ο οποίος εμπεριέχει την ατομικότητα, ενώ η ατομικότητα παράλληλα εμπεριέχει το όλον».


Η αίσθηση τού ανήκειν σε αυτά τα παιδιά που νιώθουν να μην υπάρχουν πουθενά είναι, ίσως, ό,τι σημαντικότερο θα έχει να προσφέρει μια τέτοια προσπάθεια. Μιλάμε για παιδιά χωρίς χαρτιά, χωρίς περίθαλψη, χωρίς προσοχή από τους φορείς, χωρίς χρήματα, τα οποία μέχρι τώρα θεωρούσαν την τέχνη, πολυτέλεια. Ανεξάρτητα από το καλλιτεχνικό αποτέλεσμα της χορωδίας, η πρώτη σημαντική στιγμή τού εγχειρήματος βρίσκεται στο βλέμμα των παιδιών αυτών που ακούνε την ανακοίνωση για τη συμμετοχή τους στη χορωδία. Ο Νίκος Λαλιώτης, καλλιτεχνικός διευθυντής τής χορωδίας, είχε τη χαρά να βρεθεί στο Διαπολιτισμικό Σχολείο τής Νέας Ιωνίας και, με την ενθουσιώδη υποστήριξη της διευθύντριας του σχολείου, κας Ρήγα, να ανακοινώσουν στα παιδιά το σχέδιο τής Ουτοπίας. «Ήταν απίστευτος ο ενθουσιασμός στα μάτια των παιδιών» μας λέει ο Ν. Λαλιώτης. «Ένιωσα φοβερή συγκίνηση με την αντίδρασή τους. Είναι πολύ σημαντικό να προσεγγίζεις παιδιά που βρίσκονται στο περιθώριο και να τα καλείς να ασχοληθούν με την τέχνη. Δεν γίνεται να είμαστε φοβικοί απέναντι στο διαφορετικό. Πρέπει να λήξει αυτή η νοοτροπία. Η σημασία τής χορωδίας για μένα έχει να κάνει με αυτό ακριβώς: με την ανάγκη να κάνουμε κάτι. Τώρα. Εμείς. Εμείς τώρα παίρνουμε την πρωτοβουλία να ανοίξουμε δρόμους και να διεκδικήσουμε μια ουσιαστική ζωή».


Ως μικρά παραδείγματα που θα αποτελέσουν μνήμες βλέπει το εγχείρημα η Η. Κούτρα. Η μέτζο σοπράνο Ειρήνη Καράγιαννη σημειώνει ότι, για να ασχοληθείς με τη μουσική, πρέπει να έχεις τα κατάλληλα ερεθίσματα. Πράγμα που δεν συμβαίνει στα παιδιά αυτά που θα αναλάβει να διδάξει. «Αν ζεις στο περιθώριο, χρειάζεται κάποιος να σε επιλέξει, να σε προωθήσει. Μόνο τότε μπορείς να κάνεις κάτι, όταν δεν έχεις τα ερεθίσματα. Είναι σημαντικό για τα παιδιά να μπουν σε μια ομάδα, να ενταχθούν, να γλιτώσουν από άλλους δρόμους. Εδώ, ένα παιδί μπορεί να πάρει πράγματα σε ψυχολογικό και πρακτικό επίπεδο κι ενδεχομένως να ανακαλύψει το ταλέντο του και να διαπρέψει».
Πράγματι, μπορεί, όπως συνέβη σε άλλες χώρες, να ξεχωρίσουν άνθρωποι από τη χορωδία αυτή και να διαπρέψουν. Οι οποίοι άνθρωποι, λίγα χρόνια αργότερα, μέσα από το Δίφωνο ή κάποιο άλλο μουσικό περιοδικό, να παρουσιάσουν τη δουλειά τους και τελικά να αναδειχθούν. Ενδεχομένως η απόσταση μέχρι το Μέγαρο Μουσικής να είναι μεγάλη, επεσήμανε ο Π. Μέξης, τονίζοντας: «Προσπαθούμε να αφαιρέσουμε τα οικονομικά και τα κοινωνικά εμπόδια και να αφήσουμε τα παιδιά να δημιουργήσουν». Η Ματίνα Βενετιάδου, η οποία θα διευθύνει τη χορωδία, μίλησε για τη σημασία τής ένωσης των τριών τεχνών –της μουσικής, του λόγου και της κίνησης– στην ψυχοσύνθεση των παιδιών αυτών. Και μας είπε ότι ήταν ιδιαίτερα συγκινητική η στιγμή που μια γυναίκα από το Αφγανιστάν, η οποία πουλάει αναπτήρες μόνο και μόνο για να ζήσει σε έναν τόπο χωρίς πόλεμο, έφερε το παιδί της στην πρώτη ακρόαση. «Εργάζομαι πολλά χρόνια στη μουσική εκπαίδευση» συνέχισε «αλλά πρώτη φορά βλέπω τόσο ευγενικούς ανθρώπους. Δύσκολα συναντάς τέτοια ποιότητα ανθρώπων όπως αυτοί που συνάντησα στην ακρόαση. Κι είναι σημαντικό να βλέπεις τα παιδιά που όλοι θεωρούν περιθώριο να ασχολούνται με την τέχνη.»


Το μουσικό εγχείρημα Ουτοπία έχει τύχει μέχρι στιγμής τής προσοχής καταξιωμένων μουσικών, οι οποίοι θα αναλάβουν την εκπαίδευση των παιδιών. Η λίστα με τους εθελοντές, φυσικά, παραμένει ανοιχτή. Τα παιδιά στα οποία απευθύνεται η πρόσκληση αυτή πρέπει να έχουν ηλικία από περίπου από έξι έως δεκαπέντε ετών. Προκειμένου να δημιουργηθεί ο πρώτος πυρήνας τής χορωδίας, τα παιδιά περνούν από ακρόαση. Η προσπάθεια γίνεται προς την κατεύθυνση δημιουργίας ορχήστρας, αλλά και παραπάνω από μία –ίσως– χορωδίες. Οι υπεύθυνοι του προγράμματος αυτού έχουν απευθύνει ήδη προσκλήσεις συνεργασίας σε ωδεία και ιδιώτες για τη χρησιμοποίηση ή και την παραχώρηση μουσικών οργάνων. Έχουν στείλει αιτήσεις επίσης σε υπουργεία για να τους βοηθήσουν στη δημιουργία κινήτρων για την παραμονή των παιδιών στη χορωδία. Ας μην ξεχνάμε ότι τα περισσότερα από αυτά τα παιδιά αναγκάζονται να δουλεύουν ή να στηρίζουν τις οικογένειές τους με διάφορους τρόπους. Έτσι, γίνεται έκκληση σε δημόσιους και ιδιωτικούς φορείς για τη χορήγηση φαγητού και κάρτας απεριορίστων διαδρομών στα παιδιά και στους συνοδούς τους. Άλλωστε, η Ελληνική Δράση για τα Ανθρώπινα Δικαιώματα θα φροντίζει μέσα από τις υπηρεσίες της να διεκπεραιώνει διάφορα ζητήματα νομικής, ιατρικής ή εκπαιδευτικής φύσης, ζητήματα που άπτονται άμεσα με την καθημερινότητα που βιώνουν τα παιδιά και οι οικογένειές τους.
Να αναφέρουμε, επίσης, ότι προς το παρόν το όλο εγχείρημα φιλοξενείται στο χώρο τής πολιτισμικής ομάδας Κενός Χώρος, Αγησιλάου 77Α, στο κέντρο τής Αθήνας, σε περιοχή όπου ζουν αρκετά από τα παιδιά αυτά.


Η μουσική δεν είναι πολυτέλεια, δεν αφορά μόνο μια ελίτ, δεν υπάρχει για να διαχωρίζει περαιτέρω τούς ανθρώπους, για να δημιουργεί διακρίσεις. Η μητέρα τού Αρμπέν από την Αλβανία μάς είπε ότι δεν θέλει το παιδί της να «μείνει σαν κι αυτήν». «Θέλω» είπε «να ασχοληθεί με τη μουσική για να κάνει κάτι καλύτερο από αυτά που έκανα εγώ».
Κλείνουμε αυτό το άρθρο με μια φράση τού Γκουστάβο Ντουνταμέλ, ενός από τους πιο επιβλητικούς μαέστρους τής εποχής μας, ο οποίος ξεκίνησε την επαφή του με τη μουσική μέσα από το Sistema τής Βενεζουέλας: «Κανείς δεν περίμενε ότι η κλασική μουσική θα γινόταν όπλο για την κοινωνική αλλαγή. Αλλά εμείς αποδείξαμε ότι οι ουτοπίες μερικές φορές γίνονται πραγματικότητα».

Δελτίο Τύπου της Γ.Α.Δ.Αττικής σχετικά με αποτροπή αυτοκτονίας εκδηλωθείσας μέσω διαδικτύου

Σε λεπτές ισορροπίες το σημερινό δελτίο τύπου της Γ.Α.Δ.Α. σχετικά με την "αποτροπή αυτοκτόνίας", πρόθεση για την οποία εκδηλώθηκε στο διαδίκτυο (σε κοινωνικό δίκτυο ή "παιχνίδι" -δεν μπορεί κανείς να κατανοήσει μέσα από τη σχετική ανακοίνωση).
Οι εταιρίες που διαχειρίζονται σελίδες κοινωνικών δικτύων και παιχνιδιών φαίνονται να πραγματοποιούν όχι μόνον "έλεγχο" / φιλτράρισμα των δηλώσεων των χρηστών, αλλά και εκτιμήσεις για τη σοβαρότητα των προθέσεων του δηλούντα χρήστη.
Έπειτα, με βάση τις εκτιμήσεις μιας εταιρίας που εδρεύει στην αλλοδαπή, ενεργοποιείται με εκπληκτική για τα Ελληνικά δεδομένα ταχύτητα η ΕΛ.ΑΣ., αίρεται το απόρρητο και εντοπίζεται ο καταγγελθείς (για τις ίσως πραγματικές προθέσεις του να γίνει αυτόχειρας).
Αντί να ενημερωθούν οι οικείοι του, προσκαλείται (ΜΕΤΑ τον εντοπισμό) Μη Κυβερνητική Οργάνωση για να εκτιμήσει τη σοβαρότητα του περιεχομένου των μηνυμάτων απόγνωσης.

« Αποτροπή αυτοκτονίας, εκδηλωθείσας μέσω διαδικτύου»

Από Αστυνομικούς του Τμήματος Δίωξης Ηλεκτρονικού Εγκλήματος, της Διεύθυνσης Ασφάλειας Αττικής, εντοπίσθηκε στο διαδίκτυο ημεδαπός, χρήστης του Ίντερνετ και συγκεκριμένα διαδικτυακού παιχνιδιού, σε ιστοσελίδα κοινωνικής δικτύωσης, μέσω της οποίας εκδήλωσε πρόθεση αυτοκτονίας. Η εταιρεία διαχείρισης του παιχνιδιού, που εδρεύει στην αλλοδαπή, ενημέρωσε για το μήνυμα απόγνωσης του χρήστη.

Από τη Δίωξη Ηλεκτρονικού Εγκλήματος, διενεργήθηκε άμεσα ψηφιακή ανάλυση και ενημερώθηκε η Εισαγγελία Αθηνών, για να δοθεί Εισαγγελική Παραγγελία, σχετική με το απόρρητο της επικοινωνίας.

Κατόπιν των παραπάνω εντοπίσθηκε ο ανωτέρω χρήστης του Διαδικτυακού παιχνιδιού και παράλληλα κλήθηκαν ψυχολόγοι από την Μ.Κ.Ο Κλίμακα, με σκοπό να διερευνήσουν επιστημονικά τα μηνύματα απόγνωσης, και να προσφέρουν τις υπηρεσίες τους.

Διαφάνεια στην επιλογή του Συμπαραστάτη του Δημότη και της Επιχείρησης

Στο γραφείο Δημάρχου Αθηναίων κατατέθηκε σήμερα η παρακάτω επιστολή, με την ένδειξη "εξαιρετικά επείγον" (αρ. πρωτ. 027671/14.2.2011):

Θέμα: Διαφάνεια στην επιλογή του Συμπαραστάτη του Δημότη και της Επιχείρησης

Αξιότιμε κύριε Δήμαρχε,

Αποτελούμε μια ομάδα εργασίας, η οποία έχει επεξεργαστεί μιαν ολοκληρωμένη πρόταση για την οργάνωση και λειτουργία του θεσμού του Συμπαραστάτη του Δημότη και της Επιχείρησης στον Δήμο Αθηναίων (βλ. συνημμένο σχετικό). Η πρότασή μας αναρτήθηκε στο Διαδίκτυο, στην αρχική της μορφή, στις 25 Νοεμβρίου 2010 και είναι διαθέσιμη στον διαδικτυακό τόπο http://symparastatis.wordpress.com.

Eνημερωθήκαμε για την προκήρυξη της σχετικής θέσης στις 10.2.2011, σύμφωα με την οποία καλούνται οι ενδιαφερόμενοι να υποβάλλουν τις προβλεπόμενες από το άρθρο 77 του Καλλικράτη αιτήσεις, προκειμένου το Δημοτικό Συμβούλιο να επιλέξει το κατάλληλο πρόσωπο με απόφασή του στις 28.2.2011.

Σύμφωνα με την δική μας μελέτη - πρόταση, η οποία έχει γνωρίσει αποδοχή και έχει υιοθετηθεί από άλλους Δήμους, μια από τις γενικές αρχές κατά τις οποίες πρέπει να λειτουργεί ο Συμπαραστάτης του Δημότη και της Επιχείρησης είναι η αρχή της διαφάνειας και της αμεροληψίας. Προκειμένου να διασφαλιστεί η τήρηση αυτής της αρχής, θα πρέπει η επιλογή του προσώπου να διενεργηθεί ακολουθώντας αυτά τα προτάγματα.

Η επιλογή του προσώπου μόνο βάσει της υποβολής της αίτησής του κι ενός βιογραφικού σημειώματος, χωρίς καμία προηγούμενη επίσημη παρουσίασή του ενώπιον του Δημοτικού Συμβουλίου μάλλον ευνοεί παρασκηνιακές διεργασίες, οι οποίες τυπικώς μεν δεν είναι παράνομες, υπονομεύουν όμως την (ίδια την ελπίδα για) διαφανή και με ίσους όρους συμμετοχή των ενδιαφερομένων στην διαδικασία. Διακινδυνεύει δε και εν προκειμένω την καχυποψία των πολιτών απέναντι στο νέο θεσμό - πρόσωπο. Μια τέτοια εκκίνηση της λειτουργίας του, σημειολογικά ιδωμένη, δεν θα αποτελούσε ευοίωνο μήνυμα για την μετέπειτα πορεία του. Η ήδη κλονισμένη εμπιστοσύνη των δημοτών, τους οποίους εκπροσωπείτε, θα ανακτούνταν ίσως, αν διαπιστωνόταν η διάθεση ουσιαστικής αξιολόγησης της καταλληλότητας των υποψηφίων προσώπων, αρχής γενομένης από την ίδια την υπεύθυνη επιλογή του, όπως θα εκφραστεί και μέσα από την αυτοπρόσωπη παρουσία των υποψηφίων που το επιθυμούν στο Δημοτικό Συμβούλιο και την έκθεση των (προ)θέσεών τους, του σχεδίου δράσης τους, των συναφών με τη θέση γνώσεων και των προτάσεών τους πάνω σε νευραλγικά/προβληματικά σημεία του Δήμου μας.

Η σύγχρονη παρουσία των υποψηφίων ενώπιον του Δημοτικού Συμβουλίου ή των ορισθησομένων εκπροσώπων του και η διαδοχική τοποθέτησή τους επί θεμάτων που θα τεθούν - με την παράλληλη τήρηση πρακτικών, διαθέσιμων σε κάθε Αθηναία και Αθηναίο- θα είναι, εκτιμούμε, διαφωτιστική για το εκλεκτορικό σώμα και θα συντελέσει στη διαμόρφωση ουσιαστικής εικόνας περί καταλληλότητας των υποψηφίων. Παράλληλα, θα μπορούν και οι ενδιαφερόμενοι να ενημερωθούν μέσω των πρακτικών που τηρήθηκαν για την παρουσία των υποψηφίων και να κατανοήσουν την κρίση περί καταλληλότητας για την ανάδειξη ενός εκ των υποψηφίων σε μια θέση που αφορά άμεσα τους δημότες, σε μια θέση που υπάρχει για να τους προστατεύσει από την κακοδιοίκηση και την αυθαιρεσία.

Ο Συμπαραστάτης του Δημότη και της Επιχείρησης δεν πρέπει να καταντήσει ένας θεσμός που θα μείνει "στα χαρτιά". Ένα βιογραφικό και μια δήλωση βούλησης εκτιμούμε πως δεν είναι αρκετά για να οδηγήσουν το Δημοτικό Συμβούλιο στην κρίση περί "καταλληλότητας" και τη συνακόλουθη ανάδειξη του Συμπαραστάτη, ο οποίος παραμένει "πρόσωπο" - ένα πρόσωπο που πρέπει να διαθέτει επαρκεί τυπικά και ουσιαστικά προσόντα, κοινωνική αποδοχή, με όρεξη, δυνατότητα και χρόνο για παραγωγή έργου, ώστε να διεκδικήσει με τη δράση του την εμπιστοσύνη των Αθηναίων στο θεσμό της διαμεσολάβησης.

Γι' αυτούς τους λόγους, η ομάδα μας σας προτείνει, στο πλαίσιο των κατ' άρθρο 67 παρ. 7 του Καλλικράτη αρμοδιοτήτων σας για εισήγηση θεμάτων στην ημερήσια διάταξη της συνεδρίασης του Δημοτικού Συμβουλίου, να ζητήσετε να διενεργηθεί ακρόαση των υποψηφίων, ώστε να παρουσιάσουν ενώπιον του εκλεκτορικού σώματος τις απόψεις τους για το θεσμό.

Η ομάδα μας επιθυμεί να υποστηρίξει εμπράκτως την πρότασή της για την οργάνωση και λειτουργία του Συμπαραστάτη του Δημότη και της Επιχείρησης, με την υποβολή υποψηφιότητας εκ μέρους ενός μέλους της. Καθοριστικό κριτήριο, όμως, για τη νοηματοδόητηση της συμμετοχής μας στη σχετική διαδικασία θα είναι η διενέργεια μιας όσο το δυνατόν πιο ανοικτής συζήτησης, ώστε να μπορέσουμε εύλογα να θεωρήσουμε ότι η απόφαση θα ληφθεί πράγματι στο Δημοτικό Συμβούλιο, και όχι πριν ή έξω από αυτό, ως αποτέλεσμα της διαφανούς, αμερόληπτης, ουσιαστικής, υπεύθυνης, εκπροσωπούσας τους εκλογείς κρίσης του.

Statement of the Anna Lindh Foundation on the recent events in Euro-Mediterranean region

The Anna Lindh Foundation considers of historical importance the events which are taking place in the Euro-Mediterranean region, and particularly the democratic change which has been undertaken by the people of Egypt after 18 days of a peaceful and captivating mobilization. As an institution created for promoting intercultural dialogue, the Foundation considers of utmost significance the participation in those events of men and women of all walks of life and different beliefs, united by their will to call for a better future for their country.

Based in Alexandria , the Foundation has been a privileged witness of an unprecedented social movement involving many youth striving for Freedom, dignity and Social Justice and moved by values and principles which are at the heart of the Anna Lindh Foundation mission. The Foundation praises all the peaceful demonstrators who lost their lives during those uprisings.

During those two weeks, the Foundation has been able to keep on its main activities thanks to the collaboration of the Bibliotheca Alexandrina, where our Headquarters are located, and the commitment of Alexandria citizens in defense of their cultural institutions. We want also to express our esteem and gratitude to the people of Alexandria at large, for ensuring the daily life in public spaces and neighborhoods we live in. The Foundation valued also very much the attitude of the Egyptian army contributing to the security of the population and our safety and the progressive return to normality.

The events taking place in Egypt and Tunisia have sparked interest and empathy across the Euro-Mediterranean societies. Most of the Networks of the Foundation, gathering more than 3000 civil society organizations, have expressed their admiration and solidarity with the Egyptian and Tunisian societies. They have already suggested the launching of a common Initiative focused on fostering citizenship and participation as a first answer to events, which deserve, of course, a long term and sustainable response for an institution like the Anna Lindh Foundation.

In collaboration with its Networks, the Foundation will define and launch as soon as possible an initiative responding to the new challenges we face in the region. Our main goal is to contribute to the strengthening of civil societies, and to take stock of the new demands emerging among Youth for promoting intercultural dialogue across the Mediterranean .

Some of these demands were raised during the Anna Lindh Forum organized in March 2010. Some were highlighted by the Report on Intercultural Trends published recently by the Foundation. As an institution working with and for the civil society, we consider that the recent events have more than confirmed those observations and are full of lessons, which need to be learnt and included in our programme for the coming years. We hope they will be a major contribution for the building of a common and shared Euro-Mediterranean future based on the values of freedom, dialogue, mutual respect and citizenship.

Alexandrie; 13 février 2011: La Fondation Anna Lindh considère d'une importance historique les événements qui se déroulent dans la région Euro-méditerranéenne, et en particulier le changement démocratique qui a été entrepris par le peuple de l'Egypte après 18 jours d'une mobilisation pacifique et captivante. En tant qu'institution créée pour promouvoir le dialogue interculturel, la Fondation estime de la plus haute importance la participation à ces événements d'hommes et de femmes de tous les horizons et des croyances différentes, unis par leur volonté d’appeler à un avenir meilleur pour leur pays.

Basée à Alexandrie, la Fondation a été un témoin privilégié d'un mouvement social sans précédent impliquant de nombreux jeunes luttant pour la liberté, la dignité et la justice sociale et mus par les valeurs et les principes qui sont au cœur de la mission de la Fondation Anna Lindh. La Fondation rend hommage à tous les manifestants pacifiques qui ont perdu la vie au cours de ces soulèvements.

Durant ces deux semaines, la Fondation a été en mesure de continuer ses activités principales grâce à la collaboration de la Bibliotheca Alexandrina, où notre siège social est situé, ainsi que l'engagement des citoyens d'Alexandrie pour la défense de leurs institutions culturelles. Nous voulons également exprimer notre estime et notre gratitude au peuple d'Alexandrie dans son ensemble, pour avoir permis à la vie quotidienne de continuer dans les espaces publics et les quartiers où nous vivons. La Fondation a également apprécié l'attitude de l'armée égyptienne qui a contribué à la sécurité de la population et notre sécurité ainsi qu’au retour progressif à la normalité.

Les événements qui se déroulent en Egypte et en Tunisie ont suscité un intérêt et empathie à travers les sociétés euro-méditerranéennes. La plupart des réseaux de la Fondation, regroupant plus de 3000 organisations de la société civile, ont exprimé leur admiration et leur solidarité avec les sociétés égyptienne et tunisienne. Ils ont déjà suggéré le lancement d'une initiative commune axée sur la promotion de la citoyenneté et la participation comme une première réponse à des événements qui méritent, bien sûr, une réponse à long terme et durable pour une institution comme la Fondation Anna Lindh.

En collaboration avec ses réseaux, la Fondation devra définir et lancer dès que possible une initiative afin de répondre aux nouveaux défis auxquels nous sommes confrontés dans la région. Notre objectif principal est de contribuer au renforcement des sociétés civiles, et de faire le point des nouvelles demandes émergeant parmi les jeunes pour promouvoir le dialogue interculturel à travers la Méditerranée.

Certaines de ces demandes ont été soulevées lors du Forum Anna Lindh organisé en mars 2010. Certaines ont été soulignées dans le Rapport sur les tendances interculturelles publié récemment par la Fondation. En tant qu'institution travaillant avec et pour la société civile, nous considérons que les récents événements ont plus que confirmé ces observations et sont pleins de leçons qui doivent être apprises et incluses dans notre programme pour les années à venir. فعلى مدى أسبوعين، استطاعت مؤسسة آنا ليند ان تباشر أنشطتها بفضل دعم مكتبة الاسكندرية حيث مقر المؤسسة، و بفضل مواطني الاسكندرية الذين قاموا بحماية المؤسسات الثقافية فى المدينة. كما نريد ان نعبر عن امتناننا و تقديرنا للمجتمع السكندري باكمله لعمله من اجل المحافظة على استمرارية الحياة اليومية و امن الأحياء التى نعيش بها. كما تقدر المؤسسة ايضا الدور الذى قام به الجيش من اجل المحافظة على امن المواطنين و سلامتنا و اعادة الحياة الى طبيعتها.
فالاحداث التى تشهدها مصر و تونس قد جذبت اهتمام و تضامن الشعوب الاورومتوسطية. فمعظم الشبكات التابعة للمؤسسة و التى تضم اكثر من 2500 منظمة من المجتمع المدنى، قد عبرت عن إعجابها و تضامنها مع المجتمع المصرى و التونسى. كما قاموا باقتراح لإطلاق مبادرة مشتركة حول موضوع المواطنة و المشاركة كرد فعل اولى لهذه الأحداث التى تستحق بالطبع ردة فعل طويلة المدى و دائمة من قبل مؤسسة مثل آنا ليند.
ستقوم المؤسسة، بالتعاون مع شبكتها، بصياغة و إطلاق مبادرة فى أسرع وقت ممكن تتماشى مع التحديات الجديدة التى تشهدها المنطقة. فهدفنا الاساسى هو المساهمة فى ترسيخ عمل المجتمع المدنى و موائمة المتطلبات الجديدة للشباب مما سيساهم فى تعزيز الحوار بين الثقافات فى منطقة المتوسط.

Principal facts

The applicant, Polychronis Syngelidis, is a Greek national who was born in 1957 and lives in Athens. He was married to M.A., a Member of the Greek Parliament. After their marriage broke down in late 2004, the applicant and M.A. concluded an agreement on custody and access in relation to their son, born in the same year. The arrangements were endorsed by a court decision in January 2005. The child was to live with his mother and the applicant was entitled to open access and minimum periods and certain days of contact with his son. Two months later, M.A. brought criminal proceedings against the applicant for placing a security guard outside her building. These proceedings were dismissed both at first instance and on appeal.

As the applicant had been unable to have contact with his son in accordance with the court’s decision on a number of occasions, he lodged criminal proceedings against M.A. in October 2005, requesting the sum of ten euros (EUR) as compensation for the non-pecuniary damage which her breach of the decision had caused him. The Supreme Court’s prosecutor eventually referred the matter to the President of the Greek Parliament, seeking to have M.A.’s immunity lifted. In November 2006, the Parliament’s Ethics Committee gave the opinion that the request should be denied, stating that one of the grounds provided by the relevant provision of the Parliament’s regulations applied, without further specifying. In December 2006 a majority of Parliament refused to lift the immunity, without giving any reasons. In 2007 the applicant lodged two more indictments against M.A. following alleged breaches of a new court decision on custody arrangements, which provided for payment of a fine, should she breach any of its provisions. A request for M.A.’s immunity to be lifted was again referred to the Parliament’s Ethics Committee, which rejected it in May 2008 on the grounds that it was essentially the same as the first request.

Complaints, procedure and composition of the Court

The applicant complained, relying in particular on Article 6 § 1, that the Greek Parliament’s refusal to waive his former wife’s parliamentary immunity had breached his right of access to a court.

The application was lodged with the European Court of Human Rights on 1 June 2007.

Judgment was given by a Chamber of seven judges, composed as follows:

Decision of the Court

First, the Court disagreed with the argument, brought forward by the Greek Government, that there could not have been a breach of the applicant’s right of access to a court, given that there were other legal remedies available than lodging a criminal indictment against his former wife seeking compensation for her allegedly illegal behaviour. The Court reiterated that when the domestic legal order provided an individual with a remedy, the State had a duty to ensure that the person using it enjoyed the fundamental guarantees of Article 6.

The Court further noted that in the light of that Article, the Greek Constitution entitled Parliament to refuse lifting immunity for a prosecution only where the acts on which prosecution was based were clearly connected with parliamentary activity. In the present case, there had been no conceivable link between M.A.’s alleged failure to comply with the custody arrangements with her former husband ordered by the domestic court and her functions as a Member of Parliament. Moreover, the Parliament’s Ethics Committee had not specified which of the conditions for a refusal to waive immunity, as provided for by the Parliament’s regulations, was met. The absence of any argument showing the reasoning of the Committee made it impossible for the applicant to learn about the basis of the decision. The Court further attached some significance to the fact that the impugned approach of the Parliament had created an imbalance in treatment between the applicant and M.A., since the latter was able to bring criminal proceedings against the applicant.

The Court therefore concluded, by six votes to one, that the applicant’s right under Article 6 § 1 had been violated.

Under Article 41 (just satisfaction) of the Convention, the Court, by five votes to two, awarded the applicant EUR 12,000 in respect of non-pecuniary damage.

The European Court of Human Rights was set up in Strasbourg by the Council of Europe Member States in 1959 to deal with alleged violations of the 1950 European Convention on Human Rights.

M.S.S. v. Belgium and Greece: When is a Group Vulnerable?

Any attempt to exhaustively comment on the recent landmark ruling of the Grand Chamber in M.S.S. v Belgium and Greece in one page would be bound to fail. It is an extraordinarily rich judgment. In this post, I therefore limit my comments to one single aspect I find particularly intriguing: the concept of group vulnerability. The Court has referred to several groups as “vulnerable” in its case law. One example is the Roma minority who, “as a result of their history” – the Court has held – “has become a specific type of disadvantaged and vulnerable minority” in need of special protection (Oršuš). Another example concerns persons with mental disabilities. They have been regarded as a “particularly vulnerable group in society, who has suffered considerable discrimination in the past” (Alajos Kiss).
In M.S.S., the Court speaks, once again, of the applicant as a member of a vulnerable group. The case deals with the expulsion of an Afghan asylum seeker to Greece by Belgium in application of the EU Dublin Regulation. Asylum seekers, the Court holds, are a “particularly underprivileged and vulnerable population group in need of special protection.” What makes this group vulnerable in the eyes of the Court? What are its implications for this particular case? Should asylum seekers as such be deemed vulnerable? Judge Sajó thinks not. In his separate opinion in M.S.S, he contends that asylum seekers cannot be unconditionally considered a particularly vulnerable group in the sense the Court has used this term as they are not a group “historically subject to prejudice with lasting consequences, resulting in their social exclusion.” But, should all groups fit into the idea of vulnerability the Court has used so far in its case law? In what follows, I address Judge Sajó’s criticism. But first, I briefly attempt to understand how the Court weighs up the vulnerable position of the applicant as an asylum seeker in its analysis.
Detention Conditions in Greece: Violation of Article 3
The government attempted to downplay the appalling detention conditions arguing that the duration was anyway brief. For the Court, the duration of the periods of detention was not insignificant. Plus, it observed, the fact that “the applicant, [as] an asylum seeker, was particularly vulnerable” needed to be taken into account. As Judge Sajó observes, the Court seems to be saying that the detention’s effects in this case were comparable to those of longer stays given the applicant’s vulnerability.
The Court attaches further consequences to the applicant’s vulnerable position as an asylum seeker when examining the feelings he must have experienced while detained in unacceptable conditions. The Court holds in this respect that his “distress was accentuated by the vulnerability inherent in his situation as an asylum seeker.” What I find particularly interesting about this part, is that the Court points to two factors which may deem this group vulnerable: previous experiences and trauma. The Court says: “the applicant, being an asylum seeker, was particularly vulnerable because of everything he had been through and the traumatic experiences he was likely to have endured previously.”
Living Conditions in Greece: Violation of Article 3
At first sight, the Court seems to understand in this part that the need to have due regard to the applicant’s vulnerability as an asylum seeker flows from Greece’s obligations under international and EU law to provide special protection to asylum seekers. At issue was whether the extreme poverty in which the applicant had lived in Greece amounted to degrading treatment. The Court makes it clear that Article 3 cannot be interpreted as obliging states to provide everyone with a home. Nor does this provision entail any general obligation to give refugees financial assistance to enable them to maintain certain standard of living. For the Court, however, M.S.S. could not be considered in these terms given that “the obligation to provide accommodation and decent material conditions to impoverished asylum seekers has now entered into positive law and the Greek authorities are bound to comply with their own legislation which transposes Community law” (para. 250).
Then, the Court proceeds to attach “considerable importance to the applicant’s status as an asylum seeker and, as such, a member of a particularly underprivileged and vulnerable population group in need of special protection.” Here, it refers mutatis mutandis to Oršuš and further notes “the existence of a broad consensus at the international and European level concerning this need for special protection, as evidenced by the Geneva Convention, the remit and the activities of the UNHCR and the standards set out in the European Union Reception Directive” (para. 251).
It thus seems that, as Judge Rozakis observes in his concurring opinion, what weighed heavily in the Court’s finding of a violation was the existence of international obligations on the part of Greece to guarantee asylum seekers certain material conditions, including accommodation, food and clothing (see, EU Reception Directive 2003/9). This may be confirmed by the Court’s conclusion that “…in view of the obligations incumbent on Greek authorities under the European Reception Directive […] the Greek authorities have not had due regard to the applicant’s vulnerability as an asylum seeker and must be held responsible, because of their inaction, for the situation in which he has found himself for several months, living in the street, with no resources or access to sanitary facilities, and without any means of providing for his essential needs” (para. 263).
When is a Group Vulnerable?
Unlike Judge Sajó, I do not see why all groups can be vulnerable in only one way. Why should the concept of “vulnerable group” have a specific meaning? I am not sure it is a good idea to cling to one static or fixed idea of vulnerability just because the Court has happened to term it so far in a certain way when dealing with other groups. The reasons why certain groups demand special protection may vary in number and nature. The Court’s approach in this case thus seems spot on. Vulnerability may be the result of a series of past and present (disadvantageous) circumstances in which the state could bear different degrees of responsibility. Disadvantage may in turn have multiple faces. Be it of material or dignitarian character, different types may overlap and reinforce each other. Thus, just like we should not regard vulnerability as something inherent to members of a certain group, we should not condition the idea of vulnerability to certain factors that may fit some groups but not others. Furthermore, the fact that the applicant is a member of a vulnerable group can play out in a variety of ways in the Court’s reasoning.
Ultimately, whatever the reasons at the root of groups’ vulnerabilities, what matters is the impact of certain actions (or inaction) on the part of the state on the members of such vulnerable groups. Most of the time, the impact is likely to be severe. This was certainly the case of the asylum seeker in M.S.S. I think the Court does a good job in bringing this into play. Asylum seekers are undoubtedly a vulnerable group in Greece, as numerous international reports show. But the main reason why I am sympathetic to the line of reasoning put forward by the majority in this case is because it opens up the idea of vulnerability to other circumstances and other groups. To me, it would have just not seemed sensible to stick to one fixed idea of vulnerability and offer protection only to those groups that fit into it.

Hammarberg's intervention: family reunion is a right

It is becoming more and more difficult for immigrants in Europe to have their family members join them. Even long-term residents and naturalised citizens are being deprived of this human right as policies in host countries are now becoming more restrictive and selective. Applicants have to fulfil unreasonable requirements which create insurmountable obstacles to them to living with their loved ones.

The requirements for family reunification can involve an obligation to prove ties to the host country through difficult integration tests. In several countries the applicant is required to demonstrate that he or she has a safe income and can provide decent accommodation. Moreover, only individuals within the biological nuclear family are considered for reunification – irrespective of other close relationships and dependences.

One example is the Netherlands. To be allowed to join family members there, migrants have to pass a test on Dutch society and language in their country of origin. The ‘integration exam’ is taken at a Dutch embassy or consulate, offices which are not within reach for everyone. For instance, people from Afghanistan cannot attend Dutch language lessons in their country and have to go as far as New Delhi to find a Dutch embassy.

Harsher demands raise concern

The new Dutch government has – in agreement with the Freedom Party – decided to introduce much stricter requirements for family migration “focusing on restricting and reducing the number”. It has also made clear its intention to work in the same spirit for a review of the EU Directive on the right to family reunification.

Parts of the new Dutch policy appear to be inspired by measures previously introduced in Denmark. There the minimum age for spouses who wish to reunite was raised to 24 years of age. In addition, the right to family reunification for children was made available only until the child turns 15, a decision not in line with international standards which define a child as a person below the age of 18.

In Sweden persons without a valid passport are generally prevented from qualifying for family reunification. Stricter formal rules concerning identification have made it impossible for many Somali children to reunite with their parents.

Another problem in several European countries is the slow processing of applications for family migration - even for those who can meet the strict conditions. Even in the most urgent cases the decisions now tend to come with long delays. This appears to be intentional.

We know that for many immigrants the separation from family members is a severe hardship, sometimes even a trauma which affects social and psychological well-being. For the children, who in many cases are waiting in their country of origin, the drawn out separation is certainly difficult - which in turn becomes a burden on the applicant in the host society. Obviously, living in these circumstances makes integration in the new country more complicated.

Family reunion is a right – and leads to better integration

The present trend to put further limits on family unity does not respect agreed human rights standards. The right to respect for family life is guaranteed by international conventions; in particular by the European Convention on Human Rights, the revised European Social Charter, the European Convention on the Legal Status of Migrant Workers as well as the UN Convention on the Rights of the Child.

The Council of Europe Parliamentary Assembly’s Recommendation 1686 (2004) on human mobility and the right to family reunion recommends less strict conditions for migrant applicants in respect to financial guarantees, health insurance and housing and, in particular, to avoid discrimination against women migrants and refugees which could result from the imposition of such measures.

The main message is that immigrants and refugees, who are lawfully residing in a state, should be able to reunite with their family members as soon as possible, without going through laborious procedures. Being denied the human right to be with one’s family makes life more burdensome – and integration much more difficult.
